The Humanitarian and Compassionate (H&C) pathway allows certain individuals to apply for permanent residence even if they do not meet regular immigration requirements. It is designed for exceptional cases where refusal would cause unusual or unfair hardship.
When Is H&C Used?
H&C applications may be considered when applicants:
Have strong establishment and ties to Canada
Would face hardship if required to leave
Have children in Canada, where their best interests are affected
Do not qualify as refugees but cannot reasonably return home
